Navigating a New World: Defending and Enforcing Your Technology CONSOR’s Senior Economist, Fernando Torres MSc, participated in the panel discussing the topic “Defending and Enforcing Your Technology” along with experienced IP litigators and professionals from prominent high-tech companies in Southern California. Mr. Torres discussed the current economic conditions and how they have changed optimal behavior for emerging companies which rely on patents and other intellectual property to succeed. His discussion included the latest data on non-practicing entity litigation (the so-called “patent trolls”) and the ongoing legislative Patent Law reforms moving through Congress, particularly proposed changes to infringement damages calculations.

Brand Values and Valuation in Current Economic Downturn Held in Chicago this year, the annual IP Business Congress focused on the issues raised by the current economic downturn and how it affects intellectual property. Maximizing the Value of Intellectual Property through the Auction Process
Valuation and Monetization of Corporate IP The 2009 Intellectual Property Spring Seminar presented by the Intellectual Property Law Section of the State Bar of Michigan in cooperation with the Institute of Continuing Legal Education offered attendees the opportunity to learn about the most recent intellectual property issues from nationally renowned experts. In his presentation, entitled Maximizing the Value of Corporate IP: Licensing and Beyond, featured speaker Weston Anson offered valuable insights into:
When
sales of assets take place under section 365 of the bankruptcy code,
interesting things can result: For example, how does one deal with
unexpired leases on non-residential property? What about technology
licensing issues? More importantly, what about the other intangible
assets and intellectual property found during a sale in bankruptcy?
This 90 minute program covers all four of these areas with an
emphasis on the intangible assets and IP portion. Case studies are
stressed, such as the recent sale of Tower Records and its real
estate and intangible assets, including its databases, Internet retail
sales platform, trademarks, licenses, and international franchises. We
also discuss the sale of the Collins & Aikman assets in both
Europe and the United States, and the patents, technology, and trade
secrets that were successfully sold. Finally we cover a company
currently in liquidation, Dan River Mills, that holds both real estate
and multiple elements of intellectual property ranging from copyrighted
materials to multiple trademark licenses and proprietary manufacturing
patents.
