CLIENT PROJECTS AND CASE HISTORIES

The qualifications and enthusiasm exhibited by CONSOR professionals for each project are exceptional.  We are the leaders in intellectual property licensing and trademark valuation and have a strong and experienced staff.  Most importantly, we are professional marketers who understand how to extract maximum leverage and value from intellectual property.  We specialize in assisting major corporations and other intellectual property holders in setting technology and trademark licensing policies and strategies, as well as negotiating license agreements and calculating market values that work in the marketplace.  CONSOR also specializes in the area of trademark and brand valuations.  We base our opinions on our expertise in this area and use a marketplace business approach.  We apply real world marketing criteria to our research and utilize our proprietary index of licensing and trademark information that includes over 8,000 valuation and licensing transactions.

Below we briefly outline recent assignments for a variety of clients:

Licensing and Royalty Rates:  In a typical assignment, a UK-based multinational consumer goods manufacturer had our firm develop a licensing strategy and plan identify licensing candidates, royalty rates and terms and assist in negotiations and structuring the business aspects of the deal.

Trademark and Brand Valuation:  For the Estate of Dr. Seuss, we defined specific royalty rates and a complete licensing strategy and plan.  Using our VALMATRIX® system and proprietary data, we provided a detailed valuation of all trademarks, titles, and intangible assets, for both internal use and for the IRS.

Taxes/Valuation:  Multiple clients, including Ahold, Nestle, NCR, The Limited, and Red Roof Inns, have had us put accurate values and royalty rates on their intangible assets to help ensure that their tax bills were in line with reality and to increase available relevant information for developing their tax and financing strategies.

Technology Valuation:  Several large manufacturing companies, including Ford, Exxon and Eastman Chemical, have utilized CONSOR’s expertise to pinpoint the value of technologies that they had developed, yet were not interested in commercializing.  Their interest in our services stemmed from a desire to sell or donate the technology to non-profit organizations, thereby extracting value from technology that would otherwise have been abandoned.  These are some of the many reasons we are called on to value patents, know-how, research and development, and technology.

Software:  In a typical assignment, we were engaged by IBM to determine relevant licensing practices and appropriate royalty rates for the distribution of various software programs.  The scope of this project was international, although CONSOR has access to information relevant to domestic activity as well.  The focus of our work in this area is to determine appropriate royalty rates and practices based on third party agreements.

Bankruptcy/Reorganization:  We were retained by the Court to set definitive marketplace royalty rates for Barneys, LA Gear, Boston Market, Kenar, Marvel and Western Union, leading to the establishment of market values for the names and trademarks.  Additionally, we were retained by the creditors of Macy’s to set corporate and brand trademark values, which led to their acquisition by the Federated Group.

Trademark Sales/Acquisition:  As we do for many financial services firms, we provided a complete licensing plan and trademark valuation for a highly visible client of The Blackstone Group, using our proprietary VALMATRIX® technique and our proprietary data resources.  The client’s international name and trademark was the subject of a financing negotiation and sale.

Portfolio Management:  CONSOR provides management services to organizations that have multiple components of intellectual property, including Delphion and Visteon.  Whether the IP is a portfolio of technologies and the related patents or several brand names with a multitude of sub-brands, CONSOR is able to help the organization leverage the portfolio effectively and maximize the return generated.

International Royalty Rates and Values:  Multiple clients, including IBM/Lexmark, United Technologies and General Electric, have had us establish arm`s length royalty rates, based on our proprietary data and VALMATRIX® techniques thus providing them defensible, market‑based royalty rates and values for their trademarks and technology.

Internet Assets:  CONSOR is the leading firm in developing licensing and brand extension strategies for, and calculating the value of, Internet assets.  Not only can we help your organization maximize the effectiveness of this important marketing channel, but we can also help turn it into a profit center via licensing and other leveraging techniques.  We recently launched global licensing programs for several new economy companies.

Damages/Infringement:  In a multiple client case, including Rolex and Louis Vuitton, we established the fact of infringement and the amount of damages.  Using our VALMATRIX® system, we were able to help the clients win a seven-figure court judgment.
